EB-5 Immigrant Investor Program

In 1990 the United States Congress created the employment-based immigration fifth preference (EB-5) visa category for qualified foreigners seeking to invest in businesses that benefit the U.S. economy and create or preserve jobs for U.S. workers. The EB-5 program authorizes up to 10,000 green cards (U.S. Permanent Resident Cards) per year for foreign individuals who make a qualifying job-creating investment. The program is administered by the United States Citizenship and Immigration Services (USCIS) and gives investors an opportunity to rapidly obtain a green card in exchange for making a qualifying job-creating investment in the U.S. The required investment amount is currently $500,000 for investments in certain Targeted Employment Areas (TEAs) and $1,000,000 elsewhere.

  4. File I-526 petition
  5. Obtain two year conditional permanent residency
  6. File I-829 after creation of jobs
  7. Become permanent United States resident
